RULES OF INTERACTION BETWEEN THE ONLINE STORE AND CUSTOMERS OF SANAHUNT LUXURY DEPARTMENT STORE
The Rules of Interaction between the Online Store and Customers of SANAHUNT LUXURY DEPARTMENT STORE (hereinafter referred to as the Rules, Interaction Rules, Public Agreement) is a document that defines the procedure for the purchase and sale of goods through the online store, in accordance with Article 633 of the Civil Code of Ukraine (CC), which is a public contract for the sale of goods and the provision of services related to the purchase and delivery, the text of which is presented on the SANAHUNT LUXURY DEPARTMENT STORE website at sanahunt.com.
DEFINITION OF TERMS
In this document, the following terms have the following meanings: Authorization - access to the Customer's personal account, which involves entering the login and password of registered Customers in the appropriate fields of the web page and clicking the "Login" button.
Activation - a procedure carried out according to the procedures and conditions established by this document, involving the verification of the Customer's data, giving the User the right and technical capability to make purchases using the online store.
Acceptance - full and unconditional acceptance by the User (Customer, Buyer) of the terms of the public agreement. From the moment the terms of the Public Agreement are accepted, the online store, represented by its owner, and the User of the website (Customer, Buyer) become Parties to it.
Blocking - technical and organizational actions taken by authorized employees of the online store aimed at restricting or suspending the User's (Customer's, Buyer's) access to the site's services to stop and as preventive measures against violations of this document in the manner prescribed therein.
Goods Purchase Agreement (agreement) - an agreement concluded between the Seller and the Buyer through the online store to carry out a product-money exchange between them. The terms of the agreement are established by this document.
Order - a properly completed request from the Buyer to purchase goods selected in the online store, completed using an electronic form on the site by the Customer and/or communicated by phone through a Contact Center employee. Confirmation of the Order being placed is the assignment of a unique identification number consisting of 8 digits.
SANAHUNT LUXURY DEPARTMENT STORE Online Store (online store) - a website that sells goods via the Internet.
Private Information - personal data of the Customer, information that allows the identification of the Customer when used alone or in combination with other available information.
Client - a registered User.
Authorization Code, Discount Code - the Customer's account and their personal unique identifier on the site, which also serves as a cumulative discount code and access to the Customer's Personal Account.
Code Word - a unique word (a combination of words, letters, numbers) used for the identification and verification of the User.
Party - the Seller or the Buyer under the concluded agreement.
User/Customer Login (User/Customer name) - the User's/Customer's identifier on the site used to denote them in the system, which is also used to access the User's/Customer's personal page and for other purposes specified in this document.
Public Agreement (Offer) - a public offer of the online store, represented by its owner, addressed to any individual, to accept and fulfill the terms of this document, including all its annexes.
Account Access Password - the Customer's equivalent of a handwritten signature used for the identification of the Customer.
Partner of the Online Store - a manufacturer, supplier, and/or licensor of goods and services available through the online store; a company whose name and logo may appear on the pages of the online store.
Customer's Personal Account - an electronic page on the site that contains information about the Customer's personal data, registration date, transactions carried out by the Customer, services provided by the Support Service, purchased goods, amounts, and payments, as well as other information.
Buyer - a Customer who has concluded a Goods Purchase Agreement by placing an Order and receiving confirmation of the Order from the Seller and who makes a purchase of goods or services using the online store.
User (potential Customer) - an individual who, by accessing the site address using a web browser or any other program and/or technical means, has the opportunity to view the content of the site's web pages and, depending on their actions, may acquire the status of a Customer and Buyer.
Seller - the online store represented by its Owner.
Registration - the procedure for creating a User's personal page on the site, during which the User, by filling out the appropriate forms, provides the system with the necessary information for using the site's services. Registration is considered complete only if all stages have been successfully completed in accordance with the instructions published on the site. Acceptance by the User of the terms of this document is a mandatory stage of the registration procedure. Upon completion of the registration procedure, the User acquires the status of a Customer.
Site - the website of the online store https://sanahunt.com (hereinafter - the Site), which serves as a communication platform for posting information about goods and services, the terms of their sale, and interaction with the online store.
Support Service (Contact Center) - employees of the online store (or third parties engaged on a contractual basis) who manage the site, perform technical, organizational, and other functions to ensure the operation of the site and its services, and provide informational, consulting, and other support to site Users, Customers, and Buyers.
Owner of the SANAHUNT LUXURY DEPARTMENT STORE Online Store - LLC "Deira-Trade", EDRPOU code 42976031, the legal user of intellectual property rights to the trademarks "SANAHUNT", "SANAHUNT LUXURY DEPARTMENT STORE".
Content of the Online Store Site - protected results of intellectual activity, including literary works, their titles, prefaces, annotations, articles, illustrations, covers, graphic, textual, photographic, derivative, composite, and other works intended for user interfaces, visual interfaces, brand names (trademarks), logos, software, databases, as well as the design, structure, selection, coordination, appearance, general style, and arrangement of such content included.
Goods - the object of purchase and sale (product, item, accessory) not removed from or restricted in civil circulation, offered for sale in the SANAHUNT LUXURY DEPARTMENT STORE online store by being placed in the appropriate section of the online store.
Price - the cost of the Goods established on the site, valid at the time of concluding the agreement.
Cookies - small files temporarily stored on the hard drive that allows recognizing the User's (Customer's) computer during subsequent visits to the site.
Web beacons - also known as single-pixel or clear gif technology, or action tags, web beacons are electronic images that allow the online store to count visitors to a specific page; used as a technology for collecting statistical information, they may be used on the site.
Terms used to designate site functions, its functional elements, sections, and individual services are used in the form in which they are used in the site's interface.
GENERAL PROVISIONS
The SANAHUNT LUXURY DEPARTMENT STORE online store is a legal entity registered in the prescribed manner and operating in accordance with the legislation of Ukraine under the trade name "Deira-Trade", with the organizational and legal form of LLC (Limited Liability Company) and legal address: 01103, Kyiv, Druzhby Narodiv Blvd, 10, Office 47, which operates through the internet resource sanahunt.com and related services.
These Rules, governing the relationship between the SANAHUNT LUXURY DEPARTMENT STORE online store and the User (Customer, Buyer) throughout the entire period of service provision and access of the User (Customer, Buyer) to personalized services of the Site, reflect the mutual rights and obligations of the online store represented by its Owner (Seller) and the User of the site (Customer, Buyer) in the form of a Public Agreement (offer). The use of the site's services, as well as all relations between the User (Customer, Buyer) and the online store, associated with the use of the site's services, are governed by these Rules.
By using any of the site's services or utilizing any of its functionalities, the User (Customer, Buyer) confirms that they are familiar with these Rules and all other conditions set forth on the site's pages, expresses their unconditional agreement with all the terms of these Rules, understands and accepts the terms of the Public Agreement in full without any exceptions or reservations, and undertakes to fully comply with them, as well as immediately cease using the services in case of disagreement with any condition. The User confirms that they are informed about the application of the Rules to all services currently available on the site, as well as to any development and/or addition of new services.
Acceptance (acceptance) of the terms of the Public Agreement is considered the fact of using the site by the User, which occurs at the moment of starting such use, namely: the User's transition to its address using a web browser or any other program and/or technical means that allow the content of the site's web pages to be displayed. If the User (Customer, Buyer) for any reason does not agree with the terms of these Rules in whole or in part, the owner of the SANAHUNT LUXURY DEPARTMENT STORE online store asks them to leave this site. All messages, claims, and any other correspondence sent to each other by the Parties to the Public Agreement are considered duly sent in electronic form via e-mail messages, as well as in the form of messages within the site, as provided for by its functional features (forum messages, feedback forms, publications, etc.). Correspondence is also considered properly sent if it is sent by the Parties in written form with the necessary details, in the manner provided by the current legislation of Ukraine.
The owner of the online store reserves the right to change these Rules without any special notice to third parties. The new version of the Rules takes effect from the moment of its placement on the website, unless otherwise provided by the new version of
the Rules. The current version of the Rules is always available on the page at https://sanahunt.com/.
All content of the SANAHUNT LUXURY DEPARTMENT STORE online store site is protected by copyright owned by the owner of the online store and/or third parties whose rights were transferred to the site owner on a legal basis within the framework of this project. The use of site materials without the consent of the copyright holders is not allowed. For the lawful use of site materials, the conclusion of license agreements (obtaining licenses) is required.
In case of quoting site materials, including copyrighted works that are protected, a reference to the site is mandatory and is only possible after prior approval with the owner of the online store.

RELATIONS BETWEEN THE ONLINE STORE AND THE USER
Mutual rights and obligations are reflected and detailed in these Interaction Rules. The owner of the online store recommends that persons under 18 years of age refrain from accessing the personalized services of the site. The SANAHUNT LUXURY DEPARTMENT STORE online store does not intentionally collect information from minors, including personal data, does not use or target the site content at minors.
Responsibility for the actions of minors, including the purchase of goods from the online store using the site, lies with the legal representatives of the minors.
The right to use the services of the online store is granted to individuals who have reached the age of 18 and have full legal capacity - in particular, the right to conclude legally binding contracts in accordance with the current legislation of Ukraine. To confirm the status of a Customer of the SANAHUNT LUXURY DEPARTMENT STORE online store, it is necessary to complete the registration form. At the same time, the owner of the online store reserves the right to reject any purchase request, to block the User (Customer) without providing reasons.
The User undertakes not to take actions that may be regarded as contrary to and violating Ukrainian legislation or international law, particularly in the field of intellectual property law, copyright and/or related rights, as well as any actions that lead to or may lead to a violation of the normal operation of the site and its services.
Nothing in these Rules can be understood as establishing agency relationships, partnership relations, joint activities, personal employment relations, or any other relations not directly provided for by the Rules between the User (Customer, Buyer) and the online store.
For all questions regarding information support, the User (Customer, Buyer) may contact the Customer Service Center or the Contact Center of the online store.
The User (Customer, Buyer) has the right to:
- Access the use of the site after meeting the registration requirements;
- Use all available services on the site, as well as purchase any goods offered on the site;
- Ask any questions related to the services of the online store at the contacts listed on the site;
- Use the site exclusively for the purposes and in the manner provided by the Rules and not prohibited by the legislation of Ukraine;
- At any time, demand from the online store the deletion of the Authorization Code and/or blocking of the Customer's Personal Account on the online store's site based on a corresponding request sent to the online store owner in writing.
User Obligations During Registration
To purchase goods from the SANAHUNT LUXURY DEPARTMENT STORE catalog on the site, as well as to access the personalized services of the site, the User agrees to provide accurate and complete information on the matters indicated during Registration, necessary for fulfilling the obligations of the online store regarding the purchased goods and/or access to the personalized services of the site.
The User also agrees to keep this information up to date. In the event of providing incorrect information, or if the online store owner has serious reasons to believe that the information provided by the User is incomplete and/or unreliable, the online store owner has the right to block the Customer's Personal Account and/or delete the Authorization Code and deny the User (Customer) the use of its services.
User Obligations When Using Site Services
The User (Customer) undertakes not to use the site services for:
- Violating the rights of minors and/or causing them harm in any form;
- Infringing on the rights of minorities;
- Impersonating another person (registering under the name of another individual) and/or a representative of an organization and/or community without sufficient rights, including as employees of the SANAHUNT LUXURY DEPARTMENT STORE online store;
- Misleading regarding the properties and characteristics of any goods from the online store catalog on the site; incorrect comparison of goods, as well as forming a negative attitude towards people who do not use certain goods or condemning such people;
- Uploading content that the User (Customer) does not have the right to make available under the laws of Ukraine or any contractual relationships;
- Uploading content that infringes and/or contains any patent, trademark, trade secret, trade name, copyright, and related rights, as well as other intellectual property rights that belong to or are lawfully used by third parties;
- Uploading unauthorized advertising information and/or spam;
- Collecting and processing personal data, information about the private life of any persons;
- Disrupting the normal operation of the SANAHUNT LUXURY DEPARTMENT STORE online store website;
- Violating the legislation of Ukraine and/or international law.
The User (Customer) undertakes not to use profanity, obscene, and offensive images, comparisons, and expressions, particularly concerning gender, race, nationality, profession, social category, age, language of a person and citizen, as well as regarding organizations, government bodies and local authorities, official state symbols (flags, coats of arms, anthems), religious symbols, objects of cultural heritage (historical and cultural monuments) on the site services.
The User (Customer) acknowledges and agrees that the SANAHUNT LUXURY DEPARTMENT STORE online store has the right (but not the obligation) at its own discretion to refuse to post and/or delete any content available through the personalized services of the site.
The owner of the online store strictly prohibits:
- Using any devices, programs, procedures, algorithms, and methods, automatic devices, or equivalent manual processes to access, purchase, copy or track the content of the online store site;
- Disrupting the proper functioning of the site;
- In any way bypassing the site's navigation structure to obtain or attempt to obtain any information, documents, or materials by any means not specifically provided by the site's services;
- Unauthorized access to site functions, any other systems or networks related to this site, as well as to any services offered on the site;
- Violating the security or authentication system on the site or in any network related to the site;
- Reverse searching, tracking, or attempting to track any information about any other site User;
- Using the site and its content for any purpose prohibited by the legislation of Ukraine, as well as inciting any illegal activity or other activity that violates the rights of the online store or other individuals and/or legal entities.
Customer Support
The Customer voluntarily consents to being informed about all actions of the online store related to the provision of services, particularly about the status of the Order, as well as other events of any nature related to the personalized services of the site. Information is provided by sending a message via email and/or SMS to the mobile phone number provided by the Customer at the time of Registration on the site. The online store is not responsible for delays, errors, incorrect or untimely delivery, deletion, or failure to save any messages. At the same time, the online store reserves the right to resend any message if it was not received by the Customer.
Limitation of Liability of the Online Store Owner
The online store, represented by its Owner, is not responsible for any errors, typographical errors, and inaccuracies that may be found in the materials contained on this site. The online store owner takes all necessary measures and efforts to ensure the accuracy and reliability of the information provided on the site. All informational materials are provided without any guarantees, whether express or implied. The information on the site is constantly updated and may become outdated at any time. The online store, represented by its Owner, is not responsible for receiving outdated information from the site, as well as for the User's (Customer's) inability to receive updated information stored on the site.
The online store, represented by its Owner, is not responsible for the statements and opinions of site visitors left in the form of comments or reviews. The opinion of the online store Owner may not coincide with the opinion and position of the authors of reviews and comments. At the same time, the online store takes all possible measures to prevent the publication of messages that violate the current legislation of Ukraine or moral norms.
The online store, represented by its Owner, is not responsible for any illegal actions of the User (Customer) towards third parties, or third parties towards the User (Customer).
The online store, represented by its Owner, is not responsible for damage, losses, or expenses (real or possible) that arose in connection with this site, its use or inability to use, is not responsible or liable for any suspension or termination of the functions and services of the site as a result of its own negligence (inaction) or the actions (inaction) of any third party. The online store, represented by its Owner, is not responsible for the incomplete, inaccurate, incorrect indication of the User's data during User registration.
The online store, represented by its Owner, is not responsible for the availability of resources linked to the online store site, for their content, as well as for any consequences related to the use of the content of these resources by the User (Customer).
The online store, represented by its Owner, is not responsible for the possible loss and/or damage of data that may occur due to the Customer's violation of the provisions of these Rules, as well as
incorrect access and/or use of the personalized services of the site, is not responsible for the use by the Customer or third parties of harmful software or technical means that may affect the equipment in connection with the use or download of any materials from the site, as well as for illegal interference by third parties in information systems.
The liability of the online store Owner as a result of using the website or in connection with these Rules is excluded to the extent permitted by the current legislation of Ukraine.
REGISTRATION, AUTHORIZATION, SECURITY
Registration in the online store provides the User with the non-transferable right to use their Authorization Code, which is provided to the User for access to the personalized services of the site, as well as for making purchases from the online store catalog.
Responsibility for the security of the Authorization Code, as well as for the use of the personalized services of the online store under the User's (Customer's) authorization, lies with the User (Customer). The User independently ensures the secure termination of work under their Authorization Code ("Logout" button) after the end of each session with the personalized services of the site and undertakes to maintain the confidentiality of their Authorization Code for the personalized services of the site, in particular, not to transfer their Authorization Code to third parties, as well as not to receive it from third parties.
The User (Customer) is obliged to immediately inform the online store of any case of unauthorized access to the Authorization Code and/or any violation of the security of the Customer's Personal Account on the online store's site.
In case of non-use by the Customer of access to the personalized services of the site for a sufficiently long time, the online store, represented by its Owner, reserves the right to delete the Customer's Authorization Code. The determination of the sufficiency of account inactivity in each specific case is at the discretion of the online store owner.
User Registration (assigning Customer status to the User) involves the indication of their login, access password, last name, first name, and patronymic, contact phone number, contact email address.
Customer status is assigned after the User enters the data specified in the registration form and clicks the appropriate button on the web interface with the text "Register" provided that the User ticks the checkbox next to the text "I accept the terms of the User Agreement."
After the actions described in this section of the Rules are performed by the User, a Customer's Personal Account is automatically created on the site, allowing them to start using the site's services.
The Customer is obliged to update the data provided by them during registration whenever they change.
Revocation of Customer Status
The Customer has the right to revoke their status at any time and for any reason without obtaining the consent of the online store owner. Automatically recorded information (not personal data) Upon entering the site (as a registered user), non-personal information (browser type, number of visits, average visit duration, visited pages) is automatically recorded. This information is used as an appropriate response to improve the query, content, and functionality of the site. Such information may be further used by the online store owner or transferred to third parties, except in cases where the User sends a request to stop such use to the email address help@sanahunt.ua.
Collection and Receipt of Private Information
The information received from the User before registration is not personal, and access to the site is anonymous. As mentioned above, the online store's server collects only statistical data about the type of browser, computer, operating system, and IP address. Personal data allowed for processing under these Rules are provided by the User by filling out the registration form on the online store's website and include the following information:
- User's last name, first name, and patronymic;
- User's contact phone number;
- Email address;
- Delivery address of the goods.
Providing such information to the online store is done by the User consciously and entirely voluntarily.
The site owner does not verify the accuracy of the personal data provided by the User. Private information about the User provided during the completion of registration forms may be changed or deleted by the User (Customer) in the Personal Account at any time.
The online store may also receive private information about the Customer (Buyer) from Partners or service providers (for example, about the fact of payment).
Private information is used:
- For User registration on the site and providing the User with access to the personalized resources of the online store's website;
- For identifying the Customer registered on the online store's website for the purpose of processing an order and the remote purchase and sale of goods under the terms of this Public Agreement;
- For establishing feedback with the Customer, including sending notifications, requests related to the use of the online store's website, providing services, processing requests and applications, processing and receiving payments, or notifying the Customer about the status of the order;
- To determine the User's location for security purposes, fraud prevention;
- For providing warranty or technical support;
- For feedback with the Customer, providing customer support, notifying of changes in the operation of the online store's services;
- For providing the Customer, with their consent, with offers and information about promotions, new products of the online store, online store advertising mailings;
- To improve the operation of the online store, its evaluation and analysis, improving the quality of relevant goods or services, and accumulating experience in communication with Customers.
Cookies and Web Beacons
The online store uses cookies solely for the purpose of obtaining information about the use of the site. The data in the cookies are anonymous and do not contain personal data. The web beacons technology allows the online store owner to know which User (Customer) clicked on a key element (such as a link or graphic image) on the online store's website or email. The information in web beacons is anonymous and does not contain personal data. The User can disable cookies/web beacons at any time using the browser settings.
Privacy Policy
The Privacy Policy describes the methods by which the online store protects its confidential information when the User (Customer) uses this online store, on the site of which this privacy policy is posted. This privacy policy applies only to private information obtained through the online store. The main goal of the online store's privacy policy is to provide the Customer with qualified and efficient service.
Information provided by the User to use the service (email address, mobile phone number, name; passport details - only in cases provided by law, for example, for exchange or return of goods) is not subject to transfer to third parties and disclosure. The online store takes all necessary organizational and technical measures, including cryptographic means (encryption), to protect the personal data of Users from unauthorized or accidental access by third parties, destruction, distortion, blocking, copying, dissemination, as well as other unlawful actions. The online store reserves the right to aggregate, group, and systematize original statistical data and use aggregated statistical data for the preparation of reports, conducting research, developing tools, providing services to service Users. Aggregated data does not allow obtaining any information about specific service Users without their consent.
The collected data and received information may be stored by the online store owner for an indefinite period of time.
By providing private information to the online store during registration, the User (Customer, Buyer) consents to the collection, use, transfer, and disclosure of private information in accordance with the terms of the Rules and this privacy policy.
The online store may update the privacy policy as necessary. Changes to the provisions or conditions of the privacy policy regarding the use of personal data will be reflected in this document. The online store reserves the right to make changes to certain sections of the privacy policy at any time without prior notice to the Customer (Buyer). The use of the online store after such changes take effect means that the Customer agrees that all private information about them or received from them through the online store after the publication of the updated privacy policy is subject to the terms of the updated privacy policy.
Security
The online store, represented by its Owner, guarantees the application of a range of technological, physical, and administrative measures to protect against unauthorized access, as well as to store and properly use the personal data of Customers. In particular, the site owner undertakes to ensure the storage of confidential information in secrecy, not to disclose it without prior written permission from the Customer, as well as not to sell, exchange, publish, or disclose by any other possible means the personal data provided by the Customer, except in cases expressly provided by the legislation of Ukraine and this Privacy Policy. The site owner undertakes to take precautions to protect the confidentiality of the Customer's personal data in accordance with the procedure usually used to protect such information in the existing business practice. The site owner undertakes to block the personal data related to a specific User from the moment of the User's request or request of the User's legal representative or authorized body for the protection of the rights of personal data subjects for the period of verification, in case of inaccurate personal data or unlawful actions. In accordance with the rules for storing and using personal information, access to personal data of registered users - Customers of the SANAHUNT LUXURY DEPARTMENT STORE online store - is limited. Access to the Customer's personal data is provided to Company employees, as well as to delivery services to fulfill the task of providing goods and services, who have undertaken to ensure compliance with the requirements of the Law of Ukraine "On Personal Data Protection" and obligations not to disclose the information received.
Private information may be provided to third parties exclusively in cases provided by the current legislation of Ukraine and/or with the Customer's consent. The online store reserves the right to inform relevant law enforcement or government agencies of any activity that, in its opinion, is illegal, without informing the Customer about it.
When paying for orders in the online store using payment cards, all transactions with them are carried out by banks in special secure modes. No confidential information about bank cards, except for a notification about the payment made, is transmitted to the online store and cannot be transmitted.
Standard industry methods are used to protect confidential information (such as account numbers). The Customer is
responsible for taking reasonable measures to protect private information from unauthorized access or misuse, including, but not limited to, protecting the password and other access information. All actions performed in the system using the Customer's equivalent of a handwritten signature are considered to have been personally performed by the Customer. Changes to personal data can only be made on the initiative and with the consent of the Customer.
SALE OF GOODS
Information about the goods, the terms of purchase of goods in the online store is presented on the site through photo samples that are the property of the online store. Each photo sample is accompanied by textual information: model number, price, and description of the product. The accompanying product description on the site does not claim to be exhaustive and may contain inaccuracies. The color of the product in the images is as close as possible to the original color (it should be noted that color reproduction largely depends on the individual settings of the monitor). The online store also provides (by phone, email, messengers) additional information necessary and sufficient from the Buyer's point of view for making a purchase decision. The price of the goods indicated on the site may be changed by the online store unilaterally. The goods purchased by the Customer are intended exclusively for the Customer's personal use (not for commercial purposes!).
Status "Order Accepted"
The product and its required quantity are reserved for the Customer only after the order is processed by the online store. In case the Customer edits the order before it is processed by the online store, the prices of the goods, as well as the availability of the goods in the online store, may change. Editing in this case means adding/removing goods in the order in the Customer's Personal Account. Changes to the order composition before it is processed by the online store are agreed with the Customer by phone. In case of a change in the price of the goods ordered by the Buyer, the online store immediately informs the Buyer (by phone, email) to obtain confirmation or cancellation of the order. If it is not possible to contact the Customer within 7 (seven) calendar days, including the date of the order placement, to agree on it, the order is considered canceled. After processing the order by the online store and confirming the order, it is assigned the status "order accepted", about which the Customer is informed by sending a confirmation to the email address provided during user registration and (or) by phone. All changes to the order composition, as well as all stages of the order status, are reflected in the Customer's Personal Account after the status "order accepted" is assigned. All information about the goods purchased by the Buyer is also reflected in the Customer's Personal Account.
Confirmation of an Order paid by bank transfer occurs only after the funds are credited to the Seller's account.
Up to 10 ten units of goods may be placed in one order.
Payment for Goods
The Customer has the opportunity to purchase goods in the online store by paying for them in the following ways: cash, payment card, bank transfer by receipt, Gift card.
Payment for Goods in Cash
Payment for goods in cash is provided to the Buyer when choosing the services of the online store's delivery service or in case of self-pickup of the goods. The online store's delivery service operates in the city of Kyiv and within a radius of 20 km from Kyiv.
Payment for Goods by Payment Card
The online store accepts online payments for goods using the following payment cards: Visa, Visa Electron, MasterCard, and transfers funds through JSC "Raiffeisen Bank Aval" (acquiring bank). The security of online payment processing is guaranteed by the acquiring bank. A payment card can be used to pay for the order both directly on the online store's website and through the courier's mobile POS terminal or at the Customer Service Center.
Payment for Goods by Bank Transfer
To pay for goods by bank transfer, the Customer has the opportunity to print an already completed receipt when placing an order. If it is not possible to print the receipt from the site, the Customer fills out the receipt form independently and is responsible for the accuracy of entering data into the receipt form.
In case of self-filling out the receipt form, it is necessary to indicate in the comment field to the payment the eight-digit order number placed on the site. Payment for the order by bank transfer must be made within 3 (three) banking days from the moment of its placement on the site. If the order is not paid after the specified period, the order is canceled.
When the goods are handed over to the Buyer, a cash receipt is provided.
Payment for Goods by Cryptocurrency
The online store accepts payments using cryptocurrency through the Whitepay payment system. Payment for goods using cryptocurrency is possible during working hours (from 10:00 to 17:30) daily, except for Saturday and Sunday. To pay for goods using cryptocurrency, the Customer must follow the following steps when placing an order:
Select the desired item and proceed to the payment page.
Choose the option "Pay with cryptocurrency (Whitepay)".
Select the cryptocurrency to be used for payment. The amount of the transfer in the selected currency and the exchange rate will be automatically displayed.
Copy the online store's wallet address or click "show QR".
Open your wallet and make the payment using the copied wallet address of the online store or scan the QR code using a code scanner and confirm the payment.
After successful payment, the system will automatically generate a receipt with purchase data within the next business day from the time of purchase.
The Customer independently pays all commission fees related to the payment for goods using cryptocurrency. Additional network/payment system fees may apply to transfers to and from the payment system platform account. Transactions involving fiat currency transfers from the payment system platform account are carried out by a third-party financial institution, which may apply additional fees depending on the currency of the transaction.
Return of Goods, Payment for which was Made with Cryptocurrency
The return of goods, payment for which was made with cryptocurrency, is carried out in accordance with the general rules defined by the section "Goods Return and Exchange Policy", taking into account the following:
commissions paid by the Customer are non-refundable;
the return of funds paid for the goods is made in the national currency of Ukraine (hryvnia) in non-cash form to the account details provided by the Customer.
Goods Delivery
Goods delivery is carried out throughout the entire territory of Ukraine*. Goods delivery is carried out at the expense of the online store owner. Delivery within the city of Kyiv and the suburbs within a radius of 20 km is carried out by the online store's delivery service within 1-2 calendar days from the moment the order is confirmed. The exact information about the time and date of delivery is agreed with the Customer by electronic or mobile communication.
Delivery across Ukraine is carried out by the online store's partner - a courier service within 2-7 calendar days from the moment the order is confirmed, depending on the delivery region.
The goods are delivered in branded packaging of the online store, in addition, the packaged goods are placed in a branded transport box to provide additional protection against damage and to prevent access to the goods by third parties. The transport box includes the documents for the goods. A seal is placed in the center of the lid of the transport box on the back.
Upon receipt of the goods, the Customer is obliged to check the integrity of the branded transport box and the mandatory presence of a seal, confirming that the box was not opened by third parties. In addition, the Customer is obliged to check the availability of documents for the goods.
Goods Return and Exchange Policy
The return or exchange of goods, as well as the return of funds, is carried out at the Customer Service Center, in accordance with the procedure and terms specified by the Law of Ukraine "On Consumer Protection" and this section of the Rules. The return or exchange of goods at the locations where courier delivery is carried out is carried out by the online store's courier service or by contacting the Customer Service Center. The return or exchange of goods in regions with delivery only by postal items is carried out by postal service.
To return or exchange goods, the Buyer sends a corresponding written request to the Customer Service Center at the address Kyiv, 8/16 M. Hrushevskoho St. The request is considered by the online store within 7 (seven) calendar days from the moment it is received. The return of funds is carried out provided that the Customer provides a passport, documents confirming the purchase (cash receipt, invoice, terminal receipt, bank receipt with payment mark), the returned goods, as well as a completed return act and a return request form. The return of funds for the goods is made exclusively by the method used by the Buyer for payment.
All goods purchased in the online store are covered by the Seller's warranty. The warranty period is indicated in the warranty card issued at the time of purchase. The Customer is obliged to carefully study the conditions for early termination of the warranty.
Differences in the actual design elements, such as color, shape, or appearance of the goods, from those stated in the site description, do not affect its quality and do not constitute a violation of the terms of the Public Agreement. The online store considers claims related to the improper quality of the goods only in cases where such goods contain an obvious (hidden) manufacturing defect.
The return of goods of proper quality is possible within the terms provided by the Law of Ukraine "On Consumer Protection", if the goods have not been used, have retained their marketable condition, consumer qualities, seals, tags, and are accompanied by documents issued with the goods at the time of purchase. Within 14 (fourteen) days from the date of delivery to the Customer (excluding the purchase date), the Buyer may return the goods if they did not suit the Buyer in color, size, style, shape, dimensions, for other reasons cannot be
used as intended, or exchange the goods of proper quality for similar goods from the Seller.
The exchange of non-defective goods is carried out only by agreement with the online store and only for goods available in stock. The return of non-defective goods is possible only if the goods have not been used, their consumer properties, marketable appearance, factory labels, accessories, and accompanying documents are preserved. The Buyer is obliged to notify the online store of their desire to return the goods no later than 3 (three) days from the date of receipt of the goods. To exchange goods, it is necessary to present the item in its original packaging, which has retained its marketable appearance, a warranty card, and documents confirming the purchase (cash receipt, invoice, terminal receipt, bank receipt with payment mark).
If there is no similar goods available at the time of exchange, the Buyer has the right to either purchase any other goods from the available assortment with an appropriate recalculation of the cost, or receive back the money in the amount of the returned goods, or exchange the goods for similar goods upon the first arrival of the corresponding goods in stock, which the online store will notify.
The list of goods of proper quality that are not subject to return is approved by the Resolution of the Cabinet of Ministers of Ukraine "On the Implementation of Certain Provisions of the Law of Ukraine "On Consumer Protection" dated March 19, 1994, No. 172.
In case of detection during the warranty period of significant defects caused by the manufacturer or falsification of goods, confirmed, if necessary, by an expert opinion, the Buyer, in the manner and terms established by the legislation of Ukraine, has the right at their discretion to demand from the Seller:
- Termination of the contract and return of the amount paid for the goods;
- Replacement with the same goods, free elimination of defects.
The Buyer's claims are not subject to satisfaction if the Seller, based on the expert opinion, proves that the defects of the goods arose due to the Buyer's violation of the rules for using the goods or the conditions of its storage. The Seller returns the value of the returned goods to the Buyer no later than 10 (ten) banking days from the day the Seller receives the Buyer's written request with all accompanying documents and the returned goods, provided that the complete and correct data are filled in.
The costs of courier delivery of goods in case of exchange or return are borne by the Seller.
Request for Refund
The request for a refund is completed by the Customer in the form approved by Appendix No. 1 to these Rules and is an integral part thereof.
Goods Return Act
The goods return act is drawn up in the form approved by Appendices No. 2, 3 to these Rules and is an integral part thereof.
Warranty and Post-Warranty Service
The warranty period of the goods is set by the manufacturer. If there is a document confirming the purchase of the goods, the Buyer, if necessary, for warranty service, contacts the online store's Contact Center. The warranty applies to defects in the goods that occurred due to the manufacturer's fault. Replacement of defective parts of the goods and related work is performed free of charge. The warranty period for the goods begins from the moment of sale of the goods and ends at the time indicated in the warranty card (attached to the goods) and/or in the memo at the time of purchase of the goods, taking into account the terms provided by the current legislation of Ukraine. The warranty period of the goods is extended for the duration of the goods (item) being in repair. All warranty conditions are regulated by the Law of Ukraine "On Consumer Protection".
During the warranty period, the following are permissible and are not defects:
- Wear and tear of parts (components) of the goods (item), as well as its external and internal coating during operation.
- Shrinkage or stretching of materials (fabrics) of the goods during operation and cleaning (washing) within the norm.
- Deviation of the characteristics of the goods (item) from those specified in the documentation within the norm.
The warranty does not cover:
- Items that show signs of improper use, including, but not limited to, tears, stretches, snags, impact marks, and mechanical damage: dents, chips, small scratches, deformation marks, improper cleaning, other violations of the proper use of the goods (item).
- Damage (external or internal) caused by any mechanical impact, shock, or vibration loads, the application of external force to parts of the goods (item), cracks, chips, surface scratches, deformations of materials and parts, etc.
- Damage to the goods (item) by water (detergents) as a result of a violation of the rules of use.
- Damage caused by the exposure of the goods (item) to corrosive chemicals or solvents.
- Damage to the goods (item) related to the loss of stones and other decorative elements.
The warranty is void in cases of:
- Violation of the rules for using the goods (item) or use not for its intended purpose.
- Absence of documents confirming the purchase of the goods (item).
- Contacting the Customer Service Center after the expiration of the warranty service period.
DISPUTE RESOLUTION, APPLICABLE LAW
Disputes arising from the violation (possible violation) of the terms of these Rules are resolved through negotiations. If the dispute cannot be resolved in this way, it is subject to further consideration in court in accordance with the rules of jurisdiction and competence of this category of dispute and in accordance with the current legislation of Ukraine.
