RULES OF INTERACTION BETWEEN THE ONLINE STORE AND CUSTOMERS OF THE SANAHUNT LUXURY DEPARTMENT STORE
Rules of interaction between the online store and customers of the online store SANAHUNT LUXURY DEPARTMENT STORE (hereinafter referred to as the Rules, Rules of Interaction, Public Agreement) is a document that defines the procedure for the sale and purchase of goods through the online store, in accordance with Article 633 of the Civil Code of Ukraine (CC), which is a public contract for the sale of goods and the provision of services related to the purchase and delivery of goods, the text of which is presented on the website of the online store SANAHUNT LUXURY DEPARTMENT STORE at sanahunt.com.
DEFINITION OF TERMS
In this document, the following terms have the following meanings: Authorisation means entering the Client's personal account by entering the login and password of the registered Clients in the relevant fields of the web page and clicking the "Login" button.
Activation - a procedure carried out in accordance with the procedure and conditions established by this document, provides for the verification of the Client's data, which gives the User the right and technical ability to make a purchase using the online store.
Acceptance means full and unconditional acceptance by the User (Client, Buyer) of the terms of the Public Agreement. From the moment of acceptance of the terms of the Public Agreement, the online store, represented by its owner, and the User of the site (Client, Buyer) are its Parties.
Blocking - actions of a technical and organisational nature carried out by authorised employees of the online store aimed at restricting or suspending the ability of the User (Client, Buyer) to access the services of the site in order to stop and as preventive measures against offences and violations of this document in the manner prescribed herein.
The Agreement for the Sale of Goods (Agreement) is an agreement concluded by the Seller and the Buyer through the online store in order to carry out a monetary exchange between them. The terms of the agreement are set out in this document.
Order - a duly executed request of the Buyer for the purchase of the Goods selected in the online store, executed using an electronic form on the website by the Customer and/or communicated by phone through an employee of the Contact Centre. Confirmation of the fact of placing an Order is the assignment of a unique 8-digit identification number to it.
SANAHUNT LUXURY DEPARTMENT STORE online store (online store) is a website that sells goods via the Internet.
Private information - the Client's personal data, information that allows, if used alone or in combination with other available information, to identify the Client.
Client is a registered User.
Authorisation Code, Discount Code - a Client's account and personal unique identifier on the website, which is also a cumulative discount code and access to the Client's Personal Account.
Code word - a unique word (a combination of words, letters, numbers) used to identify and verify the User.
Party - the Seller or the Buyer in accordance with the concluded agreement.
User/Customer login (User/Customer name) - an identifier of the User/Customer on the website, which serves to identify him/her in the system, which is also used to access the personal page of the User/Customer, as well as for other purposes specified in this document.
Public Agreement (Offer) - a public offer of the online store represented by its owner addressed to any individual to accept and comply with the terms of this document contained herein, including all its annexes.
The account access password is an analogue of the Client's handwritten signature used to identify the Client.
Partner of the online store - a manufacturer, supplier and/or licensor of goods and services available through the online store; a company whose name and logo may appear on the pages of the online store.
Personal Account means an electronic page on the Website containing information about the Client's personal data, date of registration, transactions performed by the Client, services provided by the Support Service, purchased goods, amounts and payments, as well as other information.
Buyer - a Customer who has concluded a contract for the sale of the Goods by placing an Order and receiving confirmation of the Order from the Seller and purchases the Goods or services through the online store.
User (potential Client) is an individual who, by clicking on the website address using a web browser or any other software and/or technical devices, has been able to display the content of the website's web pages and, depending on the actions taken by him/her, may acquire the status of a Client and a Buyer.
The Seller is an online store represented by its Owner.
Registration is the procedure for creating a personal page of the User on the Website, during which the User provides the system with the information necessary to use the Website services by filling in the relevant forms. Registration shall be deemed completed only upon successful completion of all its stages in accordance with the instructions published on the website. The User's acceptance of the terms of this document is a mandatory stage of the registration procedure. Upon completion of the registration procedure, the User acquires the status of a Client.
Website means the website of the online store https://sanahunt.com (hereinafter referred to as the Website), which is a communication platform for posting information about goods and services, terms of their sale and interaction with the online store.
Support Service (Contact Centre) - employees of the online store (third parties engaged on a contractual basis) who directly manage the site, perform technical, organisational and other functions to ensure the functioning of the site and its services, information, consulting and other support for the Site Users, Clients, Buyers.
The owner of the SANAHUNT LUXURY DEPARTMENT STORE online store is Deira-Trade LLC, EDRPOU code 42976031, the legal user of the intellectual property rights of the SANAHUNT and SANAHUNT LUXURY DEPARTMENT STORE trademarks.
The content of the website of the online store is the protected results of intellectual activity, including texts of literary works, their titles, prefaces, annotations, articles, illustrations, covers, graphic, textual, photographic, derivative, component and other works, user interfaces, visual interfaces, trademarks (trademarks for goods and services), logos, computer programs, databases, as well as the design, structure, selection, coordination, appearance, general style and arrangement of such content included in the
Goods - an object of purchase and sale (product, item, accessory), not withdrawn and not restricted in civil circulation, presented for sale in the SANAHUNT LUXURY DEPARTMENT STORE online store, by placing it in the relevant section of the online store.
Price - the price of the Goods set on the website, valid at the time of the transaction.
Cookies are small files that are temporarily stored on the hard drive, which allow the User's (Client's) computer to be recognised during subsequent visits to the website.
Web beacons - also known as single pixel or clear gif technology, or action tags, web beacons are electronic images that allow an online store to count visitors who have accessed a particular page; they are used as a technology for collecting statistical information and can be used on a website.
The terms used to describe the functions of the website, its functional elements, sections and individual services are used as they are used in the website interface.
The online store SANAHUNT LUXURY DEPARTMENT STORE is a duly registered legal entity operating in accordance with the laws of Ukraine with the company name Deira-Trade, the legal form of LLC (limited liability company) and the legal address: 10, Druzhby Narodiv Boulevard, office 47, Kyiv, 01103, Ukraine, which operates through the sanahunt.com website and related services.
These Rules, which govern the relations between the SANAHUNT LUXURY DEPARTMENT STORE online store and the User (Client, Buyer) throughout the entire period of provision of the Services and the User's (Client's, Buyer's) access to the personalised services of the Site, reflect the mutual rights and obligations of the online store represented by its Owner (Seller) and the Site User (Client, Buyer) in the form of a Public Agreement (offer). The use of the Website services, as well as all relations between the User (Client, Buyer) and the Online Shop related to the use of the Website services, are governed by these Rules.
By using any of the services of the website or using any of its functionalities, the User (the Client, the Buyer) confirms that he/she has read these Rules and all other terms and conditions set out on the website, expresses his/her unconditional consent to all the terms and conditions of these Rules, understands and accepts the terms of the Public Agreement in full without any exceptions and reservations and undertakes to comply with them in full, as well as to immediately stop using the services in case of disagreement with any of the terms and conditions. The User confirms that he/she is aware that the terms of the Rules apply to all currently available services of the Website, as well as to any development and/or addition of new services.
Acceptance of the terms of the Public Agreement shall be deemed to be the fact of use of the website by the User, which occurs at the time of the beginning of such use, namely: the User's transition to its address using a web browser or any other program and/or technical devices that allow displaying the content of the website's web pages. If the User (Client, Buyer) for any reason does not agree with the terms of these Rules in whole or in part, the owner of the SANAHUNT LUXURY DEPARTMENT STORE online store asks him to leave this site. All notifications, claims and any other correspondence sent to each other by the Parties to the Public Agreement shall be deemed to have been sent in a proper electronic form by means of e-mail messages, as well as in the form of messages within the site, in the manner provided for by its functional features (forum messages, feedback forms, publications, etc.). Correspondence shall also be deemed to be duly sent if it is sent by the Parties in writing with the necessary details in accordance with the procedure provided for by the current legislation of Ukraine.
The owner of the online store reserves the right to change these Rules without any special notification to third parties. The new version of the Rules comes into force from the moment it is posted on the website, unless otherwise provided by the new version of the Rules. All content on the SANAHUNT LUXURY DEPARTMENT STORE website is protected by the copyright of the owner of the online store and/or third parties whose rights have been legally transferred to the site owner as part of this project. Use of the materials on this website without the consent of the copyright holders is not allowed. For the legitimate use of the website materials, it is necessary to conclude licence agreements (obtain licences).
In the case of quoting materials from the site, including protected works of authorship, a link to the site is mandatory and is possible only after prior agreement with the owner of the online store.

THE RELATIONSHIP BETWEEN THE ONLINE STORE AND THE USER.
Mutual rights and obligations are reflected and detailed in these Terms of Interaction. The owner of the online store recommends that persons under the age of 18 refrain from accessing the personalised services of the site. The SANAHUNT LUXURY DEPARTMENT STORE online store does not intentionally collect information from minors, including personal data, does not use or direct the content of the site to minors.
Responsibility for the actions of minors, including the purchase of the Goods of the Online Store by them using the Website, shall be borne by the legal representatives of minors.
The right to use the services of the online store is granted to individuals who have reached the age of 18 and have full legal capacity, in particular, the right to enter into legally binding contracts in accordance with the current legislation of Ukraine. To confirm the status of a Client of the SANAHUNT LUXURY DEPARTMENT STORE online store, you must fill out a registration form. At the same time, the owner of the online store reserves the right to reject any purchase request, to block the User (Client) without giving any reason.
The User undertakes not to take any actions that may be considered as contrary to and in violation of Ukrainian legislation or international law, in particular in the field of intellectual property rights, copyright and/or related rights, as well as any actions that lead or may lead to disruption of the normal operation of the website and website services.
Nothing in these Rules may be understood as establishing between the User (Client, Buyer) and the Online Shop agency relations, partnership relations, joint venture relations, personal hire relations, or any other relations not expressly provided for by the Rules.

The User (Client, Buyer) has the right to:
- gain access to use the website after meeting the registration requirements;
- use all services available on the website, as well as purchase any Products offered on the website;
- ask any questions related to the services of the Online Shop using the details available in the website section; - use the website solely for the purposes and in the manner prescribed by the Rules and not prohibited by the legislation of Ukraine; - at any time demand that the Online Shop delete the Authorisation Code and/or block the Client's Personal Account on the Online Shop website on the basis of a request sent to the Owner of the Online Shop in writing.
Obligations of the User upon Registration
In order to purchase the Goods from the catalogue of the SANAHUNT LUXURY DEPARTMENT STORE online store on the website, as well as to access the personalised services of the website, the User agrees to provide accurate and complete information on the issues specified during the Registration and necessary to fulfil the obligations of the online store in relation to the Goods purchased and/or access to the personalised services of the website.
The User also undertakes to keep this information up to date. In case of providing incorrect information, or if the owner of the online store has serious grounds to believe that the information provided by the User is incomplete and/or unreliable, the owner of the online store has the right to block the Client's Personal Account and/or delete the Authorisation Code and refuse the User (Client) to use its services.
Obligations of the User when using the Website services
The User (the Client) undertakes not to use the services of the Website for the purpose of:
- violation of the rights of minors and/or causing them harm in any form;
- infringement of minority rights;
- impersonation (registration under the false name of an individual) and/or a representative of an organisation and/or community without sufficient rights, including employees of the SANAHUNT LUXURY DEPARTMENT STORE online store;
- misleading about the properties and characteristics of any Goods from the online store catalogue on the website; incorrect comparison of Goods, as well as the formation of a negative attitude towards persons who do not use certain Goods, or condemnation of such persons; - uploading content that the User (Client) is not entitled to make available under the laws of Ukraine or under any contractual relationship;
- uploading content that infringes and/or contains any patent, trademark (mark for goods and services), trade secret, trade name, copyright and related rights, as well as other rights to the results of intellectual activity owned or legally used by third parties;
- downloading unauthorised advertising information and/or spam;
- collection and processing of personal data, information about the private life of any persons;
- disruption of the normal operation of the website of the SANAHUNT LUXURY DEPARTMENT STORE online store;
- violation of Ukrainian and/or international law.
The User (the Client) undertakes not to use swear words, obscene and offensive images, comparisons and expressions on the website services, in particular, in relation to gender, race, nationality, profession, social category, age, language of a person and citizen, as well as in relation to organisations, state and local authorities, official state symbols (flags, coats of arms, anthems), religious symbols, cultural heritage objects (historical and cultural monuments).
The User (the Client) acknowledges and agrees that the SANAHUNT LUXURY DEPARTMENT STORE online store has the right (but not the obligation) to refuse to post and/or delete any content available through the personalised services of the website at its sole discretion.
The owner of the online store strictly prohibits it:

Information support for the Client
The Client voluntarily agrees to be informed about all actions of the Online Shop related to the provision of services, in particular about the status of the Order, as well as about other events of any nature related to the personalised services of the Website. Informing is carried out by sending a message by e-mail and/or SMS messages to the mobile phone number provided by the Client at the time of Registration on the Site. The Online Store shall not be liable for delays, failures, incorrect or untimely delivery, deletion or failure to save any messages. At the same time, the Online Store reserves the right to re-send any notification in case of non-receipt by the Client.
Limitation of liability of the owner of the online store.
The Online Shop, represented by its Owner, shall not be liable for any errors, typos and inaccuracies that may be found in the materials contained on this website. The Owner of the online store takes all necessary measures and efforts to ensure the accuracy and reliability of the information provided on the site. All information materials are provided without any warranties, either express or implied. The information on the website is constantly updated and may become outdated at any time. The Online Shop represented by its Owner shall not be liable for obtaining outdated information from the Website, as well as for the inability of the User (Client) to obtain updates of the information stored on the Website.
The Online Shop, represented by its Owner, is not responsible for the statements and opinions of the Site visitors left as comments or reviews. The opinion of the Owner of the Online Shop may not coincide with the opinion and position of the authors of reviews and comments. At the same time, the online store takes all possible measures to prevent the publication of messages that violate the current legislation of Ukraine or moral standards.
The Online Store, represented by its Owner, shall not be liable for possible illegal actions of the User (Client) against third parties, or third parties against the User (Client).
The Online Shop, represented by its Owner, shall not be liable for any damage, losses or expenses (actual or possible) arising in connection with this Website, its use or inability to use it, shall not be liable or responsible for any suspension or termination of the functions and services of the Website as a result of its own negligent actions (inaction) or actions (inaction) of any third party. The Online Shop, represented by its Owner, shall not be liable for incomplete, inaccurate, incorrect indication of the User's data during the User's registration.
The Online Shop, represented by its Owner, shall not be liable for the availability of resources, links to which may be contained on the Online Shop's website, for their content, as well as for any consequences associated with the use of the content of these resources by the User (Client).
The Online Shop, represented by its Owner, shall not be liable for any loss and/or damage to data that may occur due to the Client's violation of the provisions of these Rules, as well as improper access and/or use of personalised services of the Website, shall not be liable for the use by the Client or third parties of malicious software or hardware that may affect the equipment in connection with the use or download of any materials from the Website, as well as for illegal interference by third parties with information systems.
The liability of the Owner of the Online Store as a result of using the Website or in connection with these Rules is excluded to the extent permissible under the current legislation of Ukraine.
REGISTRATION, AUTHORISATION, SECURITY.
Registration in the Online Shop grants the User a non-transferable right to use his/her Authorisation Code, which is provided to the User to access personalised services of the Website, as well as to make purchases from the Online Shop catalogue.
The User (Client) shall be responsible for the security of the Authorisation Code, as well as for the use of the personalised services of the Online Shop under the authorisation of the User (Client). The User shall independently log out of their Authorisation Code ("Logout" button) after each session of work with the personalised services of the Website and undertake to ensure the confidentiality of their Authorisation Code to the personalised services of the Website, in particular, not to transfer their Authorisation Code to third parties, as well as not to receive it from third parties.
The User (the Client) is obliged to immediately notify the Online Shop of any case of unauthorised access to the Authorisation Code and/or any breach of security of the Client's Personal Account on the Online Shop's website.
If the Client does not use access to the personalised services of the Website for a sufficiently long time, the Online Shop, represented by its Owner, reserves the right to delete the Client's Authorisation Code. The determination of the sufficiency of the account inactivity in each particular case remains at the discretion of the Owner of the Online Store.
The User's registration (assignment of the Client status to the User) shall consist in specifying the User's login, access password, surname, name and patronymic, contact phone number, contact e-mail address.
The Client status shall be assigned after the User enters the data specified in the registration form and clicks the corresponding button on the web interface with the text "Register", provided that the User ticks the box next to the text "I accept the terms of the User Agreement".
After the User's actions described in this section of the Rules, the Client's Personal Account is automatically created on the website, which allows the User to start using the website services.
The Client undertakes to make changes to the data specified by him/her during registration each time they change.
Cancellation of the Client's status The Client has the right to cancel his/her status at any time and for any reason without obtaining the consent of the owner of the online store. Automatically recorded information (non-personal data) When you log in to the site (as a registered user), non-personal information (browser type, number of visits, average visit duration, pages visited) is recorded automatically. This information is used as a response to improve the request, content and functionality of the website. Such information may be further used by the owner of the online store or transferred to third parties, unless the User sends a request to terminate such use to the email address email@example.com.
Obtaining and collecting private information
The information received from the User prior to registration is not personal, the entrance to the site is anonymous. As indicated above, the server of the online store collects only the type of browser, computer and operating system, as well as the IP address for statistics. The personal data permitted for processing under these Rules is provided by the User by filling out the registration form on the website of the online store and includes the following information:
- surname, name, patronymic of the User;
- contact phone number of the User;
- email address (e-mail);
- the delivery address of the goods.
The User shall provide such information to the Online Store knowingly and exclusively on a voluntary basis.
The Website Owner does not verify the accuracy of personal data provided by the User. Private information about the User provided by him/her when filling in the registration forms may be changed or deleted by the User (Client) in the Personal Account at any time.
The Online Store may also receive private information about the Client (Buyer) from Partners or service providers (for example, the fact of payment).
Private information is used:
- to register the User on the Website and provide the User with access to the personalised resources of the Website of the Online Shop;
- to identify the Client registered on the website of the online store, to place an order and purchase and sale of goods remotely under the terms of this Public Agreement;
- to establish feedback with the Client, including sending notifications, requests regarding the use of the online store website, provision of services, processing requests and applications, processing and receiving payments or notifying the Client of the status of the order;
- to determine the location of the User for security purposes and to prevent fraud;
- for the purpose of providing warranty or technical support;
- to provide feedback to the Client, to provide customer support, to notify about changes in the operation of the online store services;
- to provide the Client, with his/her consent, with offers and information about promotions, new products of the Online Shop, advertising mailings of the Online Shop;
- to improve the operation of the online store, evaluate and analyse it, improve the quality of the relevant goods or services, and gain experience in communicating with Customers.
Cookies and Web Beacons
The information transmitted by the User for the purpose of using the service (e-mail address, mobile phone number, name; passport data - only in cases provided for by law, for example, for the exchange or return of goods) shall not be transferred to third parties and disclosed. The Online Store takes all necessary organisational and technical measures, including cryptographic means (encryption), to protect the personal data of Users from unauthorised or accidental access by third parties, destruction, modification, blocking, copying, distribution, as well as from other illegal actions. The Online Shop reserves the right to aggregate, group and systematise the initial statistical data and use the aggregated statistical data for compiling reports, conducting research, developing tools, and providing services to the Service Users. Aggregated data does not allow obtaining any information about specific Users of the Service without their consent.
The data collected and the information received may be stored by the owner of the online store for an unlimited amount of time.
Private information may be provided to third parties only in cases provided for by the current legislation of Ukraine and/or with the consent of the Client. The Online Shop reserves the right to notify the relevant law enforcement or governmental authorities of any activity that, in its opinion, is illegal without informing the Client thereof.
When paying for orders in the online store using payment cards, all transactions with them are carried out by banks in special secure modes. No confidential information about bank cards, other than a notification of the payment made, is transferred to the online store and cannot be transferred.
Standard industry practices are used to protect confidential information (e.g. account number). The Client is responsible for taking reasonable measures to protect private information from unauthorised access or misuse, including, but not limited to, protecting the password and other access information. All actions performed in the system using an analogue of the Client's handwritten signature shall be deemed to be performed personally by the Client. Changes to personal data may be made solely on the initiative and with the consent of the Client.
SALE OF GOODS
Information about the Goods, the terms and conditions of purchase of goods in the online store is presented on the website through photo samples that are the property of the online store. Each photo sample is accompanied by textual information: model number, price and description of the product. The description accompanying the Product on the Website does not claim to be exhaustive and may contain inaccuracies. The colour of the goods in the pictures is as close as possible to the colour of the original (please note that the colour reproduction depends largely on the individual monitor settings). The Online Store also provides (by phone, e-mail, messengers) additional information necessary and sufficient from the point of view of the Buyer to make a decision on the purchase of goods. The price of the goods indicated on the Website may be changed by the Online Shop unilaterally. The goods purchased by the Client are intended solely for the Client's personal use (not for commercial purposes!).
Status "Order accepted"
The Goods and their required quantity are reserved for the Client only after the order is processed by the Online Shop. If the Customer edits the composition of the order before it is processed by the Online Shop, the prices for the Goods, as well as the availability of the Goods in the Online Shop, may change. In this case, editing means adding/deleting the Goods in the order in the Customer's Personal Account. Changing the composition of the order before it is processed by the Online Shop shall be agreed with the Client by phone. In case of change in the price of the goods ordered by the Customer, the Online Shop shall immediately inform the Customer (by phone, by e-mail) to receive confirmation or cancellation of the order. In case of impossibility to contact the Customer within 7 (seven) calendar days, including the date of placing the order, to agree on it, the order shall be considered cancelled. After the Online Shop processes the order and confirms the order, it is assigned the status of "order accepted", about which the Client is notified by sending a confirmation to the e-mail specified during the user registration and/or by phone. All changes in the order composition, as well as all stages of the order status, shall be displayed in the Customer's Personal Account after the "order accepted" status is assigned. All information about the Goods purchased by the Buyer is also displayed in the Client's Personal Account.
Confirmation of the Order paid by bank transfer occurs only after the funds are credited to the Seller's account.
Up to 10 ten units of goods can be placed in one order.
Payment for the goods.
The Client has the opportunity to purchase the Goods in the online store by paying for them in the following ways: in cash, by payment card, by bank transfer with a receipt, by Gift Card.
Payment for the Goods in cash.
Payment for the Goods in cash is provided to the Buyer when choosing the services of the online store delivery service or in case of pickup of the Goods. The delivery service of the online store operates in Kyiv and within a radius of 20 km from Kyiv.
Payment for the Goods by payment card
The Online Store accepts online payments for the Goods using the following payment cards: Visa, Visa Electron, MasterCard and transfers funds through PJSC Raiffeisen Bank Aval (acquiring bank). The security of online payment processing is guaranteed by the acquiring bank. The payment card can be used to pay for the Order both directly on the website of the online store and through the courier's mobile POS terminal or in the Customer Service Centre.
Payment for the Goods by bank transfer
In order to pay for the Goods by bank transfer, the Client has the opportunity to print a pre-filled receipt when placing an Order. If it is not possible to print a receipt from the website, the Client shall fill in the receipt form independently and shall be responsible for the correctness of the data entered in the receipt form.
If you fill in the receipt form yourself, you must indicate the eight-digit order number placed on the website in the comment field to the payment. Payment for the Order by bank transfer must be made within 3 (three) banking days from the date of its placement on the website. In case of non-payment after the expiry of the specified period, the order shall be cancelled.
Upon delivery of the Goods, the Buyer shall be provided with a cash receipt.
Delivery of the Goods
Delivery of the Goods is carried out throughout Ukraine*. Delivery of the Goods is carried out at the expense of the owner of the online store. Delivery in the city of Kyiv and to the suburbs of Kyiv within a radius of 20 km is carried out by the delivery service of the online store within 1-2 calendar days from the date of order confirmation. The exact information about the time and date of delivery shall be agreed with the Client via electronic or mobile communication.
Delivery in Ukraine is carried out by the online store's partner, a courier service, within 2-7 calendar days from the date of order confirmation, depending on the delivery region.
Delivery of the Goods is carried out in the original packaging of the online store, in addition, the packaged Goods are placed in a branded shipping box for additional protection against damage and to prevent access to the Goods by third parties. Documents for the Goods are placed in the pocket of the shipping box. A seal shall be placed in the centre of the lid gluing line on the back of the shipping box.
Upon receipt of the Goods, the Client is obliged to check the integrity of the branded shipping box and the mandatory presence of a seal confirming that the box has not been opened by third parties. In addition, the Client is obliged to check the availability of documents for the Goods.
Return and exchange policy of the Goods
The return or exchange of the Goods, as well as the refund, is carried out at the Customer Service Centre, in accordance with the procedure and terms specified by the Law of Ukraine "On Consumer Protection" and this section of the Rules. Return or exchange of the Goods in places where courier delivery is carried out shall be carried out by the courier service of the online store or by contacting the Customer Service Centre. The return or exchange of the Goods in regions with delivery only by postal items is carried out by means of the postal service.
In order to return or exchange the Goods, the Buyer shall send a corresponding written request to the Customer Service Centre at 8/16 M. Hrushevskoho Str., Kyiv. The Online Shop shall consider the application within 7 (seven) calendar days from the date of its receipt. Refunds are made subject to the provision by the Client of a passport, documents confirming the purchase (cash receipt, invoice, payment terminal receipt, bank receipt with a note of payment), the returned goods, as well as a completed goods return certificate and an application for a refund. Refunds for the Goods shall be made exclusively in the manner used by the Buyer when paying for them.
All goods purchased in the online store are covered by the Seller's warranty. The warranty period is indicated in the warranty card issued at the time of purchase of the Goods. The Customer is obliged to carefully study the terms of early termination of the warranty.
The difference between the actual design elements, such as colour, shape or design of the Goods, from those stated in the description on the website does not affect its quality and is not a violation of the terms of the Public Agreement. The Online Shop shall consider claims related to the improper quality of the Goods only in cases where such Goods contain an obvious (hidden) manufacturing defect.
Return of the Goods of good quality is possible within the terms stipulated by the Law of Ukraine "On Protection of Consumer Rights", if the Goods have not been in use, have retained their presentation, consumer qualities, seals, labels, and are accompanied by documents, within 14 (fourteen) days from the date of transfer of the Goods to the Client (excluding the day of purchase), the Buyer may return the Goods if they do not fit the Buyer in colour, size, style, shape, dimensions, or for other reasons cannot be used for their intended purpose, or exchange the Goods of good quality for similar ones from the Seller.
The exchange of defective Goods is carried out only by agreement with the Online Store and only for the Goods that are in stock. The return of defective Goods is possible only if the Goods have not been used, their consumer properties, presentation, factory labels, accessories and accompanying documents have been preserved. The Buyer is obliged to notify the online store of the desire to return the Goods no later than 3 (three) days from the date of receipt of the Goods. In order to exchange the Goods, it is necessary to present the product in its original packaging, which has retained its presentation, a warranty card and documents confirming the purchase (cash receipt, invoice, payment terminal receipt, bank receipt with a note of payment).
If at the time of the exchange a similar Product is not on sale, the Buyer has the right to either purchase any other products from the available range with the corresponding recalculation of the cost, or receive a refund in the amount of the cost of the returned Product, or exchange the Product for a similar one, provided that the relevant product is available for sale as soon as it is notified by the online store.
The list of goods of good quality that cannot be returned is approved by Resolution of the Cabinet of Ministers of Ukraine "On Implementation of Certain Provisions of the Law of Ukraine "On Protection of Consumer Rights" No. 172 dated 19 March 1994.
In case of detection during the warranty period of significant defects caused by the fault of the manufacturer of the Goods or falsification of the Goods, confirmed, if necessary, by an expert opinion, the Buyer shall have the right to demand from the Seller, in the manner and within the terms established by the legislation of Ukraine, at its sole discretion:
- termination of the Agreement and refund of the amount paid for the Goods;
- replacement with the same Goods, free elimination of defects.
The Buyer's claims shall not be satisfied if the Seller proves on the basis of an expert opinion that the defects of the Goods arose as a result of the Buyer's violation of the rules for the use of the Goods or the conditions of their storage. The Seller shall return to the Buyer the cost of the returned Goods no later than 10 (ten) banking days from the date of receipt by the Seller of the Buyer's written application with all accompanying documents, the returned Goods, provided that the complete and correct data is filled in.
The costs of courier delivery of the goods in case of exchange or return shall be borne by the Seller.
Application for a refund The application for a refund shall be filled in by the Client in the form approved by Appendix No. 1 to these Rules and is an integral part of them.
Act of return of goods
The Return of Goods Act shall be drawn up in the form approved by Appendices Nos. 2 and 3 to these Rules and shall be an integral part thereof.
Warranty and post-warranty service
The warranty period for the Goods is set by the manufacturer. In the presence of a document confirming the purchase of the Goods, the Buyer shall contact the Contact Centre of the Online Store in case of need for warranty service. The warranty covers defects in the Goods caused by the manufacturer. Replacement of defective parts of the Goods and related work is free of charge. The warranty period for the Goods begins from the moment of sale of the Goods and ends at the time specified in the warranty card (attached to the Goods) and/or in the memo at the time of purchase of the Goods, taking into account the terms provided for by the current legislation of Ukraine. The warranty period shall be extended by the time the Goods (product) are under repair. All warranty terms are governed by the Law of Ukraine "On Protection of Consumer Rights".
It is permissible during the warranty period and does not constitute a defect:
- Wear and tear of parts (parts) of the Goods (product), as well as its external and internal coating during operation.
- Shrinkage or stretching of the materials (fabrics) of the Goods during operation and cleaning (washing) within the normal range.
- Deviations of the characteristics of the Goods (product) from those specified in the documentation within the normal range.
The warranty does not apply to:
- Products with traces of operational failure, in particular, but not limited to, tears, stretching, tightening, traces of impact and mechanical damage: dents, nicks, small scratches, traces of deformation, improper cleaning, other violations of the proper operation of the Goods (product).
- Damage (external or internal) caused by any mechanical impact, shock or vibration loads, application of external force to parts of the Goods (product), cracks, chips, scratches, scuffs, scuffing of surfaces, deformation of materials and parts, etc.
- Damage to the Goods (product) by water (detergents) due to violation of the operating rules.
- Damage caused by exposure of the Goods (product) to caustic chemicals or solvents.
- Damage to the Goods (product) caused by the loss of stones and other decorative elements.
The warranty is void in the following cases:
- Violation of the rules of operation or use of the Goods (product) for other purposes.
- Absence of documents confirming the purchase of the Goods (product).
- Contact the Customer Service Centre after the warranty period has expired.
DISPUTE RESOLUTION, APPLICABLE LAW.
Disputes arising from the violation (possible violation) of the terms of these Rules shall be resolved through negotiations. If it is impossible to resolve the dispute in the above way, it shall be subject to further consideration in court in accordance with the rules of jurisdiction and jurisdiction of this category of dispute and in accordance with the current legislation of Ukraine
