RULES OF INTERACTION BETWEEN THE ONLINE STORE AND THE ONLINE STORE’S CUSTOMERS
SANAHUNT LUXURY DEPARTMENT STORE
The Rules of Interaction between the online store and the customers of SANAHUNT LUXURY DEPARTMENT STORE (hereinafter referred to as the “Rules,” “Rules of Interaction,” or “Public Agreement”) are a document defining the procedure for the sale and purchase of goods through the online store, in accordance with Article 633 of the Civil Code of Ukraine (CCU), and constitute a public contract (public offer) for the sale and purchase of goods and the provision of services related to the processing of a purchase and its delivery, the text of which is published on the website of SANAHUNT LUXURY DEPARTMENT STORE at sanahunt.com.
DEFINITION OF TERMS
In this document, the following terms shall have the meanings set forth below:
Authorization means logging into the Customer’s personal account by entering the login and password of registered Customers in the relevant fields of the webpage and clicking the “Log In” button.
Activation means a procedure carried out in accordance with the procedure and conditions established by this document, which provides for verification of the Customer’s data and grants the User the right and technical ability to make a purchase through the online store.
Acceptance means the full and unconditional acceptance by the User (Customer, Buyer) of the terms of the public agreement. From the moment of acceptance of the terms of the Public Agreement, the online store represented by its owner and the website User (Customer, Buyer) become the Parties thereto.
Blocking means technical and organizational actions performed by authorized employees of the online store aimed at restricting or suspending the ability of the User (Customer, Buyer) to access the website’s services in order to stop and, as a preventive measure against, offenses and violations of this document in the manner established herein.
Agreement for the Sale and Purchase of Goods (transaction) means a transaction concluded through the online store by the Seller and the Buyer for the purpose of carrying out an exchange of goods for money between them. The terms of the transaction are established by this document.
Order means a duly completed request of the Buyer for the purchase of Goods selected in the online store, made by means of an electronic form on the website by the Customer themselves and/or communicated by phone through a Contact Center employee. Confirmation that the Order has been placed is the assignment of a unique 8-digit identification number thereto.
SANAHUNT LUXURY DEPARTMENT STORE online store (online store) means a website that sells goods via the Internet.
Private information means the Customer’s personal data, i.e. information that, when used alone or in combination with other available information, makes it possible to identify the Customer.
Customer means a registered User.
Authorization Code means a unique one-time number provided to the User (Customer) by sending an SMS message during registration and each time the Customer logs into their Personal Account.
Code Word means a unique word (combination of words, letters, digits) used to identify and verify the User.
Party means the Seller or the Buyer under the concluded transaction.
User’s/Customer’s Login (User’s/Customer’s name) means the identifier of the User/Customer on the website, which serves to designate them in the system and is simultaneously used to access the User’s/Customer’s personal page, as well as for other purposes specified in this document.
Public Agreement (Offer) means the public offer of the online store represented by its owner, addressed to any individual, to accept and comply with the terms of this document, including all appendices thereto.
Online Store Partner means a manufacturer, supplier and/or licensor of goods and services available through the online store; a company whose name and logo may appear on the pages of the online store.
Customer’s Personal Account (Account) means an electronic page on the website containing information about the Customer’s personal data, registration date, transactions performed by the Customer, support services provided by the Support Service, purchased goods, amounts and payments, as well as other information.
Buyer means a Customer who has entered into an agreement for the sale and purchase of Goods by placing an Order and receiving confirmation from the Seller that the Order has been placed, and who purchases Goods or services through the online store.
User (potential Customer) means an individual who, as a result of accessing the website address using a web browser, mobile application or any other software and/or technical means, has obtained the ability to view the content of the website pages or its mobile version and, depending on their actions, may acquire the status of Customer and Buyer.
Seller means the online store represented by its Owner.
Registration means the procedure for creating the User’s personal page on the website, during which the User, by filling in the relevant forms, provides the system with the information necessary to use the website’s services. Registration shall be deemed completed only upon successful completion of all its stages in accordance with the instructions published on the website. Acceptance by the User of the terms of this document is a mandatory stage of the registration procedure. Upon completion of the registration procedure, the User acquires the status of Customer.
Website means the online store website — https://sanahunt.com and the mobile version of the online store website — the SANAHUNT mobile application developed for the iOS platform, which constitute a communication platform for posting information about goods and services, the terms of their sale and interaction with the online store (hereinafter referred to as the “Website”).
Support Service (Contact Center) means the employees of the online store (third parties engaged on a contractual basis) who directly manage the website, perform technical, organizational and other functions to ensure the operation of the website and its services, and provide informational, consultative and other support to website Users, Customers and Buyers.
Owner of the SANAHUNT LUXURY DEPARTMENT STORE online store means Deira-Trade LLC, EDRPOU code 42976031, the lawful holder of intellectual property rights to the SANAHUNT and SANAHUNT LUXURY DEPARTMENT STORE trademarks.
Content of the online store website means protected results of intellectual activity, including texts of literary works, their titles, forewords, annotations, articles, illustrations, covers, graphic, textual, photographic, derivative, composite and other works, user interfaces, visual interfaces, names of trademarks (marks for goods and services), logos, computer programs, databases, as well as the design, structure, selection, coordination, appearance, general style and arrangement of such content incorporated into the website and its mobile version.
Goods means an object of sale and purchase (product, item, accessory) that is not withdrawn from or restricted in civil circulation and is offered for sale in the SANAHUNT LUXURY DEPARTMENT STORE online store by being posted in the relevant section of the online store.
Price means the price of the Goods set on the website and valid at the time the transaction is concluded.
Cookies means small files temporarily stored on the hard drive that make it possible to recognize the User’s (Customer’s) computer during subsequent visits to the website.
Web beacons, also known as single pixel, clear gif technology or action tags, are electronic images that enable the online store to count visitors who have accessed a particular page; they are used as a technology for collecting statistical information and may be used on the website.
Push Token means a unique technical identifier that enables services to send notifications to a specific User’s (Customer’s) device and is key to the operation of the push notification system.
Terms used to designate the functions of the Website, its functional elements, sections and individual services shall be used in the form in which they appear in the interface of the website and its mobile version.
GENERAL PROVISIONS.
SANAHUNT LUXURY DEPARTMENT STORE online store is a legal entity duly registered and operating in accordance with the laws of Ukraine under the trade name Deira-Trade, with the organizational legal form of LLC (limited liability company), having its legal address at: Office 47, Building 10, Druzhby Narodiv Boulevard, Kyiv, 01103, and conducting its activities through the sanahunt.com online resource, the SANAHUNT mobile application developed for the iOS platform, and the related services.
These Rules regulating the relations between SANAHUNT LUXURY DEPARTMENT STORE online store and the User (Customer, Buyer) throughout the entire period of provision of Services and access of the User (Customer, Buyer) to the personalized services of the website and/or its mobile version reflect the mutual rights and obligations of the online store represented by its Owner (Seller) and the User of the website and/or its mobile version (Customer, Buyer) in the form of a Public Agreement (offer). Use of the services of the website and/or its mobile version, as well as all relations between the User (Customer, Buyer) and the online store related to the use of the services of the website and/or its mobile version, shall be governed by these Rules.
By using any of the services of the website and/or its mobile version or by making use of any of its functional features, the User (Customer, Buyer) confirms that they have read these Rules and all other terms set out on the pages of the website and its mobile version, express their unconditional consent to all terms of these Rules, understand and accept the terms of the Public Agreement in full, without any exceptions or reservations, and undertake to comply with them in full, and also to immediately cease using the services in the event of disagreement with any of the terms.
The User confirms that they have been informed that the terms of the Rules apply to all services of the website and/or its mobile version currently available, as well as to any development (update) thereof and/or addition of new services.
Acceptance of the terms of the Public Agreement shall be deemed to occur upon the User’s use of the website and/or its mobile version, which occurs at the moment such use begins, namely: when the User accesses its address using a web browser or any other software and/or technical means allowing the content of the website pages to be displayed, and/or downloads the SANAHUNT mobile application developed for the iOS platform. If the User (Customer, Buyer), for any reason, does not agree with the terms of these Rules in whole or in part, the owner of SANAHUNT LUXURY DEPARTMENT STORE requests that they leave this website and/or refrain from downloading the SANAHUNT mobile application developed for the iOS platform. All notices, claims and any other correspondence sent by the Parties to the Public Agreement to one another shall be deemed duly sent in electronic form by means of e-mail messages, as well as in the form of messages within the Website in the manner предусмотренного by its functional features (forum messages, feedback forms, publications, etc.). Correspondence shall also be deemed properly sent if it is sent by the Parties in written form with the necessary details in the manner provided for by the current legislation of Ukraine.
The owner of the online store reserves the right to amend these Rules without any special notice to third parties. The new version of the Rules shall become effective from the moment it is posted on the website and/or in the SANAHUNT mobile application, unless otherwise provided by the new version of the Rules. The current version of the Rules is always available at https://sanahunt.com/ and/or in the SANAHUNT mobile application.
All content of the SANAHUNT LUXURY DEPARTMENT STORE Website is protected by copyright of the owner of the online store and/or third parties whose rights were lawfully transferred to the owner of the Website within the framework of implementation of this project. Use of Website materials without the consent of the right holders is not permitted. Lawful use of Website materials requires the conclusion of license agreements (obtaining licenses).
In the event of quotation of Website materials, including protected copyrighted works, a reference to the Website is mandatory and is only possible after prior agreement with the owner of the online store.

RELATIONS BETWEEN THE ONLINE STORE AND THE USER.
The mutual rights and obligations are reflected and detailed in these Rules of Interaction. The owner of the online store recommends that persons under 18 years of age refrain from accessing the personalized services of the Website. SANAHUNT LUXURY DEPARTMENT STORE online store does not intentionally collect information received from minors, including personal data, and does not use or target the content of the Website to minors.
Responsibility for the actions of minors, including the purchase by them of Goods from the online store using the Website, shall rest with the legal representatives of such minors.
The right to use the services of the online store shall belong to individuals who have reached the age of 18 and have full legal capacity, including the right to enter into legally binding contracts, in accordance with the current legislation of Ukraine. In order to confirm the status of a Customer of SANAHUNT LUXURY DEPARTMENT STORE online store, it is necessary to fill out the registration form. At the same time, the owner of the online store reserves the right to reject any purchase request and to block the User (Customer) without stating reasons.
The User undertakes not to perform actions that may be regarded as contrary to or violating Ukrainian legislation or norms of international law, in particular in the field of intellectual property rights, copyright and/or related rights, as well as any actions that result or may result in disruption of the normal functioning of the Website and the Website’s services.
Nothing in these Rules shall be construed as establishing agency relations, partnership relations, joint activity relations, employment relations, or any other relations between the User (Customer, Buyer) and the online store that are not expressly provided for by the Rules.
For any questions concerning informational support, the User (Customer, Buyer) may contact the Customer Service Center or the online store’s Contact Center.
The User (Customer, Buyer) has the right to:
gain access to use the Website after complying with the registration requirements;
use all services available on the Website, as well as purchase any Goods offered on the Website;
ask any questions relating to the services of the online store using the details indicated in the relevant section of the Website (thereby granting the online store consent to record, analyze and store such text messages and/or telephone calls and/or voice messages for the internal use of the online store);
use the Website exclusively for the purposes and in the manner provided for by the Rules and not prohibited by the legislation of Ukraine;
at any time require the online store to delete the Authorization Code and/or block the Customer’s Personal Account on the online store Website on the basis of a corresponding written request sent to the owner of the online store.
User Obligations upon Registration
In order to purchase Goods from the catalog of SANAHUNT LUXURY DEPARTMENT STORE online store on the website, as well as to gain access to the personalized services of the Website, the User agrees to provide accurate and complete information on the matters specified during Registration, which is necessary for the online store to fulfill its obligations with respect to the Goods being purchased and/or access to the personalized services of the Website.
The User also undertakes to keep this information up to date. In the event that inaccurate information is provided, or if the owner of the online store has serious grounds to believe that the information provided by the User is incomplete and/or inaccurate, the owner of the online store shall have the right to block the Customer’s Personal Account and/or delete the Authorization Code and refuse the User (Customer) the use of its services.
User Obligations when Using the Website Services
The User (Customer) undertakes not to use the Website services for the purpose of:
violating the rights of minors and/or causing them harm in any form;
infringing the rights of minorities;
impersonating another person (registering under another individual’s name) and/or a representative of an organization and/or community without sufficient rights to do so, including employees of SANAHUNT LUXURY DEPARTMENT STORE online store;
misleading as to the properties and characteristics of any Goods from the online store catalog on the Website; making incorrect comparisons of Goods, as well as creating a negative attitude toward persons who do not use certain Goods, or condemning such persons;
uploading content that the User (Customer) has no right to make available under the legislation of Ukraine or under any contractual relations;
uploading content that affects and/or contains any patent, trademark (mark for goods and services), trade secret, trade name, copyright and related rights, as well as other rights to results of intellectual activity belonging to or lawfully used by third parties;
uploading advertising information and/or spam not specifically permitted;
collecting and processing personal data and information about the private life of any persons;
disrupting the normal functioning of the SANAHUNT LUXURY DEPARTMENT STORE online store website;
violating the legislation of Ukraine and/or international legal norms.
The User (Customer) undertakes not to use abusive words, indecent or offensive images, comparisons and expressions on the Website services, including with respect to gender, race, nationality, profession, social category, age, language of a person and citizen, as well as with respect to organizations, state authorities and local self-government bodies, official state symbols (flags, coats of arms, anthems), religious symbols, and cultural heritage objects (historical and cultural monuments).
The User (Customer) acknowledges and agrees that SANAHUNT LUXURY DEPARTMENT STORE online store has the right (but not the obligation), at its own discretion, to refuse to post and/or delete any content available through the Website’s personalized services.
The owner of the online store strictly prohibits:
using any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or monitor the content of the online store Website;
violating the proper functioning of the Website;
bypassing the Website’s navigation structure in any way to obtain or attempt to obtain any information, documents or materials by any means not specifically made available through the services of this Website;
unauthorized access to the Website’s functions, any other systems or networks related to this Website, as well as any services offered on the website;
breaching the security or authentication system on the website or on any network related to the Website;
performing reverse lookups, tracking or attempting to track any information about any other User of the Website;
using the Website and its content for any purpose prohibited by the legislation of Ukraine, as well as inciting any illegal activity or other activity that violates the rights of the online store or other individuals and/or legal entities.
Customer Information Support
The Customer gives their voluntary consent to be informed about all actions of the online store related to the provision of services, in particular about the status of Order fulfillment, as well as about any other events of any nature related to the personalized services of the Website. Such informing shall be carried out by sending messages by e-mail and/or SMS messages to the mobile phone number provided by the Customer at the time of Registration on the Website. The Parties may also exchange voice messages in the mobile version of the website. The online store shall bear no responsibility whatsoever for delays, failures, incorrect or untimely delivery, deletion or non-preservation of any messages. At the same time, the online store reserves the right to resend any message if it is not received by the Customer. The Customer is informed that the online store uses artificial intelligence in the course of its operations and has no objections thereto.
Limitation of Liability of the Owner of the Online Store.
The online store represented by its Owner shall bear no liability whatsoever for any errors, typographical errors and inaccuracies that may be found in the materials contained on this Website. The owner of the online store takes all necessary measures and efforts to ensure the accuracy and reliability of the information provided on the website. All informational materials are provided without any warranties, whether express or implied. The information on the Website is constantly updated and may become outdated at any time. The online store represented by its Owner shall not be liable for obtaining outdated information from the Website, as well as for the inability of the User (Customer) to obtain updated information stored on the Website.
The online store represented by its Owner shall bear no liability whatsoever for statements and opinions of Website visitors left as comments or reviews. The opinion of the Owner of the online store may not coincide with the opinions and positions of the authors of reviews and comments. At the same time, the online store takes all possible measures not to allow the publication of messages that violate the current legislation of Ukraine or moral standards.
The online store represented by its Owner shall not be liable for possible unlawful actions of the User (Customer) with respect to third parties, or of third parties with respect to the User (Customer).
The online store represented by its Owner shall not be liable for damage, losses or expenses (actual or potential) arising in connection with this Website, its use or inability to use it, and shall not bear responsibility or obligations for any suspension or termination of the functioning of the Website’s functions and services as a result of its own negligent acts (omissions) or the acts (omissions) of any third party. The online store represented by its Owner shall not be liable for incomplete, inaccurate or incorrect indication by the User of their data during User registration.
The online store represented by its Owner shall bear no liability whatsoever for the availability of resources linked to on the online store Website, for their content, or for any consequences related to the use by the User (Customer) of the content of such resources.
The online store represented by its Owner shall bear no liability whatsoever for the possible loss and/or corruption of data that may occur due to the Customer’s violation of the provisions of these Rules, as well as improper access to and/or use of the Website’s personalized services; nor shall it be liable for the use by the Customer or third parties of malicious software or technical means that may affect equipment in connection with the use or downloading of any materials from the Website, or for unlawful interference by third parties in information systems.
The liability of the Owner of the online store arising from the use of the website and its mobile version shall be excluded to the extent permitted by the current legislation of Ukraine.
REGISTRATION, AUTHORIZATION, SECURITY.
Registration in the online store grants the User the non-transferable right to use their Personal Account, which is created for the User in order to provide access to the Website’s personalized services, as well as to make purchases from the online store catalog. Access to the Personal Account is carried out by the User (Customer) entering the Authorization Code in the relevant field on the Website.
Responsibility for the security of the Authorization Code, as well as for the use of the online store’s personalized services under the User’s (Customer’s) authorization, shall rest with the User (Customer). The User independently performs secure termination of the session under their Authorization Code (the “Log Out” button) after each session of work with the Website’s personalized services and undertakes to ensure the confidentiality of their Authorization Code for access to the Website’s personalized services, including not transferring their Authorization Code to third parties, as well as not obtaining it from third parties.
The User (Customer) is obliged to immediately notify the online store of any case of unauthorized access to the Authorization Code and/or of any breach of security of the Customer’s Personal Account on the online store Website.
Registration of the User (assignment of the status of Customer to the User) is carried out by entering the contact phone number in the relevant field on the Website, clicking the button marked “SMS,” receiving a one-time code in an SMS message to the entered phone number (Authorization Code), confirming by the User the fact of acceptance of the terms of the public offer, and logging in by means of the Authorization Code into the automatically created Personal Account.
After the actions of the User described in this section, the User (Customer) is able to start using the Website’s services.
The Customer undertakes to make changes to the data specified by them during registration each time such data changes.
Cancellation of Customer Status
The Customer has the right to cancel their status at any time and for any reason without obtaining the consent of the owner of the online store.
Automatically Recorded Information (Non-Personal Data)
Upon entering the Website (as a registered User), non-personal information (browser type, number of visits, average visit duration, visited pages) is recorded automatically. This information is used as an appropriate response for the purpose of improving the query, content and functionality of the website. Such information may subsequently be used by the owner of the online store or transferred to third parties, except where the User sends a request to stop such use to help@sanahunt.ua.
Receiving and Collecting Private Information
Information received from the User prior to registration is not personal; entry to the Website is anonymous. As noted above, the online store server collects only the type of browser, computer and operating system, as well as the IP address, for statistical purposes. Personal data permitted to be processed under these Rules is provided by the User by filling out the registration form on the online store Website and may include the following information:
the User’s surname, first name and patronymic;
the User’s contact phone number;
e-mail address;
delivery address of the goods.
Provision of such information to the online store is carried out by the User knowingly and exclusively voluntarily.
The Owner of the Website does not verify the accuracy of the personal data provided by the User. Private information about the User provided by them when filling in registration forms may at any time be changed or deleted by the User (Customer) in their Personal Account.
The online store may also receive private information about the Customer (Buyer) from Partners or service providers (for example, regarding the fact of payment).
Private information is used:
to register the User on the Website and provide the User with access to the personalized resources of the online store Website;
to identify the Customer registered on the online store Website for the purpose of placing an order and conducting distance sale and purchase of goods under the terms of this Public Agreement;
to establish feedback with the Customer, including sending notifications and requests related to the use of the online store Website, provision of services, processing requests and applications, processing and receiving payments, or informing the Customer about the order status;
to determine the User’s location for the purpose of ensuring security and preventing fraud;
for the purpose of providing warranty or technical support;
to carry out feedback with the Customer, provide customer support, and notify about changes in the operation of the online store’s services;
to provide the Customer, with their consent, with offers and information about promotions, new items of the online store, and advertising mailings of the online store;
to improve the operation of the online store, evaluate and analyze it, improve the quality of relevant goods or services, and accumulate experience in communicating with Customers (including, but not limited to, for the implementation of this purpose, the online store may use and store Customer survey results, reviews, processed requests and applications, recordings of telephone conversations with the Customer, Customer voice messages, etc.).
Cookies and Web Beacons
The online store uses cookies solely for the purpose of obtaining information about the use of the website. The data in cookies files is anonymous and does not contain personal data. Web beacon technology enables the owner of the online store to know which User (Customer) clicked on a key element (such as a link or graphic image) on the website or in the online store’s e-mail.
Information in web beacons is anonymous and does not contain personal data. The User may at any time disable cookies/web beacons through their browser settings.
Privacy Policy.
The Privacy Policy describes the methods by which the online store protects its confidential information when the User (Customer) uses this online store, on the website of which the text of this Privacy Policy is posted. This Privacy Policy applies only to private information obtained through the online store. The main purpose of the online store’s Privacy Policy is to provide the Customer with qualified and effective service.
Information transmitted by the User for the purpose of using the service (e-mail address, mobile phone number, name; passport data — only in cases provided by law, for example, for exchange or return of goods) shall not be transferred to third parties or disclosed. The online store takes all necessary organizational and technical measures, including cryptographic means (encryption), to protect Users’ personal data against unauthorized or accidental access by third parties, destruction, distortion, blocking, copying, distribution, as well as other unlawful actions. The online store reserves the right to aggregate, group and systematize initial statistical data and to use aggregated statistical data to prepare reports, conduct research, develop tools, and provide services to service Users.
Aggregated data does not make it possible to obtain any information about specific service Users without their consent.
The collected data and obtained information may be stored by the owner of the online store for an unlimited period of time. The owner of the online store reserves the right to delete information that has lost relevance for the User’s use of the service in order to optimize the operation of the website without obtaining the User’s prior consent.
By providing the online store with private information during registration, the User (Customer, Buyer) consents to the receipt, use, transfer and disclosure of private information in accordance with the terms of the Rules and this Privacy Policy.
Where necessary, the online store may update the Privacy Policy. If the provisions or terms of the personal data usage policy are changed, such changes will be reflected in this document. The online store reserves the right to amend certain sections of the Privacy Policy at any time without prior notice to the Customer (Buyer). Use of the online store after such changes take effect shall mean the Customer’s consent that all private information concerning them or received from them through the online store after publication of the updated Privacy Policy is governed by the terms of the updated Privacy Policy.
Security
The online store represented by its Owner guarantees the application of a range of technological, physical and administrative measures to protect against unauthorized access, as well as to store and properly use Customers’ personal data. In particular, the owner of the website undertakes to keep confidential information secret, not to disclose it without the Customer’s prior written permission, and also not to sell, exchange, publish, or disclose by any other possible means the Customer’s personal data transferred to it, except in cases expressly provided for by the legislation of Ukraine and this Privacy Policy. The owner of the website undertakes to take precautions to protect the confidentiality of the Customer’s personal data in accordance with the procedure normally used to protect this type of information in existing business practice. The owner of the Website undertakes to block personal data relating to a particular User from the moment of application or request by the User, their legal representative, or the authorized body for the protection of the rights of personal data subjects for the period of verification in the event of detection of inaccurate personal data or unlawful actions. In accordance with the rules for storage and use of personal information, access to the personal data of registered users — Customers of SANAHUNT LUXURY DEPARTMENT STORE online store — is restricted. Access to the Customer’s personal data is granted to the Company’s employees, as well as to delivery services for the purpose of fulfilling the task of providing goods and services, and such persons have undertaken obligations to ensure compliance with the requirements of the Law of Ukraine “On Personal Data Protection” and obligations of non-disclosure of the received information.
Private information may be provided to third parties exclusively in cases provided for by the current legislation of Ukraine and/or with the Customer’s consent. The online store reserves the right to notify relevant law enforcement or governmental authorities of any activity that, in its opinion, is unlawful, without informing the Customer thereof.
When paying for orders in the online store by payment cards, all transactions with such cards are carried out by banks in special secure modes. No confidential information about bank cards, other than a notification of the completed payment, is transferred to the online store and cannot be transferred thereto.
Standard industry methods are used to protect confidential information (for example, an account number). The Customer is responsible for taking reasonable measures to protect private information from unauthorized access or misuse, including, but not limited to, protecting the password and other access information. All actions performed in the system using an analogue of the Customer’s handwritten signature shall be deemed to have been performed personally by the Customer. Changes to personal data may be made solely at the initiative of and with the consent of the Customer.
SALE OF GOODS
Information about the Goods and the conditions for purchasing goods in the online store are presented on the Website through photo samples, which are the property of the online store. Each photo sample is accompanied by textual information: model number, price and description of the goods. The description of the Goods accompanying them on the Website is not intended to be exhaustive and may contain inaccuracies. The color of the goods in the images is as close as possible to the original color (it should be taken into account that color rendering largely depends on the individual monitor settings). The online store also provides (by phone, via e-mail, messengers) additional information necessary and sufficient, from the Buyer’s point of view, for the Buyer to make a decision on purchasing the goods. The price of the goods indicated on the Website may be changed by the online store unilaterally. Goods purchased by the Customer are intended exclusively for the Customer’s personal use (not for commercial purposes!).
“Order Accepted” Status
The goods and the required quantity thereof are reserved for the Customer only after the order has been processed by the online store. If the Customer edits the order contents before the order is processed by the online store, the prices of the Goods, as well as the availability of the Goods in the online store, may change. Editing in this case means adding/removing Goods in the order in the Customer’s Personal Account. Any change to the contents of the order before it is processed by the online store shall be agreed with the Customer by phone. If the price of the goods ordered by the Buyer changes, the online store shall immediately inform the Buyer thereof (by phone, by e-mail) in order to obtain confirmation or cancellation of the order. If it is impossible to contact the Customer within 2 (two) calendar days, including the date of order placement, in order to agree on the order, the order shall be deemed canceled. After the order is processed by the online store and confirmed, it is assigned the status “order accepted,” of which the Customer is informed by sending a confirmation to the e-mail address specified during user registration and/or by phone. All changes to the contents of the order, as well as all stages of the order status, are displayed in the Customer’s Personal Account after the status “order accepted” is assigned.
All information about the Goods purchased by the Buyer is also displayed in the Customer’s Personal Account.
Confirmation of an Order paid by bank transfer occurs only after the funds have been credited to the Seller’s account.
Up to 10 ten units of goods may be included in one order.
Payment for the Goods.
The Customer may purchase Goods in the online store by paying for them in the following ways: cash, payment card, bank transfer by receipt, cryptocurrency.
Payment for the Goods in cash.
Payment for the Goods in cash is available to the Buyer when choosing the online store’s delivery service or in the case of self-pickup of the Goods. The online store’s delivery service operates within the city of Kyiv and within a radius of 20 km from Kyiv.
Payment for the Goods by payment card
The online store accepts online payments for the Goods by means of the following payment cards: Visa, Visa Electron, MasterCard, and transfers funds through PJSC Raiffeisen Bank Aval (acquiring bank). The security of online payment processing is guaranteed by the acquiring bank. The Order may be paid by payment card either directly on the online store website or through the courier’s mobile POS terminal or at the Customer Service Center.
Payment for the Goods by bank transfer
To pay for the Goods by bank transfer, the Customer, when placing the Order, has the opportunity to print out an already completed receipt. If it is not possible to print the receipt from the website, the Customer shall fill out the receipt form independently and shall be responsible for the correctness of the data entered in the receipt form.
If the receipt form is filled out independently, the eight-digit order number placed on the website must be indicated in the payment comment field.
Payment for the Order by bank transfer must be made within 3 (three) banking days from the moment of placement on the website. If the order is not paid after the expiration of the specified term, the order shall be canceled.
Upon transfer of the Goods to the Buyer, a cash receipt shall be provided.
Payment for the Goods by cryptocurrency
The online store accepts payments using cryptocurrency through the Whitepay payment system. Payment for the goods using cryptocurrency is possible during the business day (from 10:00 to 17:30) daily, except Saturday and Sunday. To pay for the Goods by cryptocurrency, the Customer, when placing the Order, must follow these steps:
Select the desired goods and go to the payment page.
Choose the option “Payment by cryptocurrency (Whitepay)”.
Select the cryptocurrency in which they wish to make payment. The transfer amount in the selected currency and the exchange rate will be displayed automatically.
Copy the online store wallet address or click “show QR”.
Open their wallet and make payment to the copied online store wallet address or scan the QR code using a code scanner and confirm the payment.
After successful payment, the system will automatically generate a receipt containing the purchase details on the next business day following the purchase of the goods.
The Customer shall independently pay all commissions related to payment for the Goods by cryptocurrency. Additional network/payment system fees may apply to transfers to and from the account on the payment system platform. Transfers of fiat funds from the account on the payment system platform are performed by a third-party financial institution, which may apply additional fees depending on the currency of the transaction.
Return of Goods paid for in cryptocurrency shall be made in accordance with the general rules set forth in the section “Goods Return and Exchange Policy,” taking into account the following:
commission payments paid by the Customer are non-refundable;
refunds for goods shall be made in the national currency of Ukraine (hryvnia) in non-cash form to the bank details specified by the Customer.
Delivery of the Goods
Delivery of the Goods is carried out throughout the territory of Ukraine*. Delivery of the Goods is at the expense of the owner of the online store. Delivery within the city of Kyiv and to the suburbs of Kyiv within a radius of 20 km is carried out by the online store’s delivery service within 1–2 calendar days from the moment the order is confirmed. Exact information about the time and date of delivery shall be agreed with the Customer by electronic or mobile communication.
Delivery throughout Ukraine is carried out by the online store’s partner — a courier service — within 2–7 calendar days from the moment the order is confirmed, depending on the delivery region.
The Goods are delivered in the online store’s branded packaging; in addition, the packaged Goods, for the purpose of additional protection against damage and prevention of access to the Goods by third parties, are placed in a branded transport box. Documents for the Goods are placed in the pocket of the transport box. A seal must be affixed in the center of the lid gluing line on the back side of the transport box.
Upon receipt of the Goods, the Customer is obliged to check the integrity of the branded transport box and the mandatory presence of the seal, which confirms that the box has not been opened by third parties. In addition, the Customer is obliged to check for the presence of documents for the Goods.
Goods Return and Exchange Policy
Return or exchange of the Goods, as well as refund of funds, is carried out at the Customer Service Center in accordance with the procedure and time limits specified in the Law of Ukraine “On Consumer Rights Protection” and this section of the Rules.
Return or exchange of the Goods in places where courier delivery is carried out shall be performed by the online store’s courier service or by the Customer applying to the Customer Service Center. Return or exchange of the Goods in regions where delivery is only by postal items shall be carried out via the postal service.
In order to return or exchange the Goods, the Buyer shall send the relevant written request to the Customer Service Center at: 8/16 M. Hrushevskoho St., Kyiv. The application shall be considered by the online store within 7 (seven) calendar days from the moment of receipt thereof. Refund of funds shall be carried out provided that the Customer submits a passport, documents confirming the purchase (cash receipt, delivery note, payment terminal receipt, bank receipt marked as paid), the returned goods, as well as a completed goods return report and an application for refund of funds. Refund of funds for the Goods shall be made exclusively by the method used by the Buyer when paying for them, taking into account the exceptions provided for by these Rules.
All goods purchased in the online store are covered by the Seller’s warranty. The warranty period is specified in the warranty card issued at the time of purchase of the Goods. The Customer is obliged to carefully study the conditions for early termination of the warranty.
Differences in actual design elements, such as color, shape or appearance of the Goods, from those stated in the description on the website do not affect their quality and do not constitute a breach of the Public Agreement. The online store considers claims related to improper quality of the goods only in cases where such goods contain an obvious (hidden) manufacturing defect.
Return of goods of proper quality is possible within the periods provided for by the Law of Ukraine “On Consumer Rights Protection,” provided that the Goods have not been used, have retained their merchantable condition, consumer properties, seals, labels, and are accompanied by the documents issued together with the Goods upon their purchase. Within 14 (fourteen) days from the moment the Goods are transferred to the Customer (excluding the day of purchase), the Buyer may return the Goods if they did not suit the Buyer by color, size, style, shape, dimensions, or for other reasons cannot be used by them for their intended purpose, or exchange the Goods of proper quality for analogous goods from the Seller.
Exchange of non-defective Goods shall be performed only upon agreement with the online store and only for Goods that are available. Return of non-defective Goods is possible only if the Goods have not been used and their consumer properties, merchantable condition, factory labels, accessories and accompanying documents have been preserved. The Buyer is obliged to notify the online store of the wish to return the Goods no later than 3 (three) days from the moment of receipt of the Goods. To exchange the Goods, it is necessary to present the product in its original packaging, preserving its merchantable condition, the warranty card, and documents confirming the purchase (cash receipt, delivery note, payment terminal receipt, bank receipt marked as paid).
If analogous Goods are not available for sale at the time of exchange, the Buyer has the right either to purchase any other goods from the available assortment with the corresponding recalculation of cost, or to receive back the money in the amount of the cost of the returned Goods, or to exchange the Goods for analogous goods upon the first arrival of the relevant goods for sale, about which the online store will notify them.
The list of goods of proper quality not subject to return is approved by the Resolution of the Cabinet of Ministers of Ukraine “On implementation of certain provisions of the Law of Ukraine ‘On Consumer Rights Protection’” dated March 19, 1994 No. 172.
If, during the warranty period, significant defects caused by the manufacturer of the Goods, or falsification of the Goods, are discovered and, where necessary, confirmed by an expert opinion, the Buyer, in the procedure and within the time limits established by the legislation of Ukraine, has the right, at their discretion, to demand from the Seller:
termination of the agreement and return of the monetary amount paid for the Goods;
replacement with the same Goods, free elimination of defects.
The Buyer’s claims shall not be satisfied if the Seller, on the basis of an expert opinion, proves that the defects of the Goods arose as a result of the Buyer’s violation of the rules of use of the Goods or the conditions of their storage. The Seller shall refund the Buyer the value of the returned Goods no later than 10 (ten) banking days from the day the Seller receives the Buyer’s written application with all accompanying documents and the returned Goods, provided that complete and correct data are filled in.
The costs of courier delivery of the goods in the event of exchange or return shall be borne by the Seller.
Refund Application and Goods Return Report
The refund application and goods return report shall be drawn up in the form available at: https://sanahunt.com/return-form and form an integral part of these Rules.
Warranty and Post-Warranty Service
The warranty period for the Goods is established by the manufacturer. If the Buyer has a document confirming the purchase of the goods, in case warranty service is required, the Buyer shall contact the online store’s Contact Center. The warranty applies to defects in the Goods that arose through the fault of the manufacturer. Replacement of low-quality parts of the Goods and related work is performed free of charge. The warranty period of operation for the Goods begins from the moment of sale of the Goods and ends at the time specified in the warranty card (which is attached to the Goods) and/or in the memo provided upon purchase of the Goods, taking into account the periods provided for by the current legislation of Ukraine. The warranty period of operation is extended for the period during which the Goods (product) are under repair. All warranty conditions are governed by the Law of Ukraine “On Consumer Rights Protection.”
During the warranty period, the following are allowed and shall not be considered defects:
Wear of parts (components) of the Goods (product), as well as of its external and internal coating during operation.
Shrinkage or stretching of materials (fabrics) of the Goods during operation and cleaning (washing) within the normal range.
Deviation of the characteristics of the Goods (product) from those specified in the documentation within the normal range.
The warranty does not apply to:
Products showing signs of improper use, including, but not limited to, tears, stretching, pulls, traces of impact and mechanical damage: dents, chips, minor scratches, signs of deformation, improper cleaning, and other violations of proper use of the Goods (product).
Damage (external or internal) caused by any mechanical impact, shock or vibration loads, application of external force to parts of the Goods (product), cracks, chips, scratches, surface abrasions, deformation of materials and parts, etc.
Damage to the Goods (product) caused by water (cleaning agents) due to violation of operating rules.
Damage caused by the impact of caustic chemicals or solvents on the Goods (product).
Damage to the Goods (product) related to the falling out of stones and other decorative elements.
The warranty shall be invalid in cases of:
Violation of the operating rules or use of the Goods (product) not for their intended purpose.
Absence of documents confirming purchase of the Goods (product).
Application to the Customer Service Center after expiration of the warranty service period.
DISPUTE RESOLUTION, APPLICABLE LAW.
Disputes arising as a result of violation (possible violation) of the terms of these Rules shall be resolved through negotiations. If a dispute cannot be resolved in this manner, it shall be subject to further consideration in court in accordance with the rules of jurisdiction and venue applicable to this category of disputes and in accordance with the current legislation of Ukraine.
